1. Overview

This website and booking platform are operated by Atlas & Nation Ltd (“Atlas & Nation”, “we”, “us”, “our”). By booking a tour or using our site, you agree to comply with and be bound by these Combined Terms of Service & Booking Conditions (“Terms”). Please read them carefully before making a booking.

Where we combine and sell, or offer for sale, at an inclusive price at least two different types of travel service for the same trip, Atlas & Nation Ltd acts as the “organiser” for the purposes of the Package Travel and Linked Travel Arrangements Regulations 2018 (“Package Travel Regulations”).

Atlas & Nation Ltd intends to protect client funds via a UK travel trust scheme in line with the Package Travel Regulations 2018 (for example, membership of Protected Trust Services (PTS)).

We are currently in pre-launch and not yet accepting bookings. Once trust membership is confirmed and sales open, client payments will be handled in accordance with that trust scheme and any associated financial protection (such as ATOL for qualifying flight-inclusive packages), and this clause will be updated accordingly.

These Terms apply to:

  • All bookings made with Atlas & Nation Ltd directly or via our website

  • Your use of our website and online store

 

2. Booking, Contract Formation & Payments

2.1 Who can book

To make a booking, the lead guest (“you”, “the lead traveller”) must:

  • Be at least 18 years old

  • Have authority to accept these Terms on behalf of all persons named on the booking

  • Ensure all information supplied is complete and accurate

2.2 When your contract is formed

A binding contract is formed when we:

  • Receive your completed booking form or online booking details

  • Receive the required first payment

  • Issue a Booking Confirmation (normally by email)

Please check your Booking Confirmation carefully and notify us immediately of any errors. Later changes may incur amendment fees.

2.3 Flexible payment options (no separate deposit)

Unless otherwise stated, you may choose to:

  • Pay in full at the time of booking, or

  • Pay by instalments under an agreed schedule

The first instalment is payable at booking and secures your place. Instalment plans are only available where sufficient time exists before departure.

2.4 Balance due date

All balances must be paid no later than 30 days before the tour start date (“Balance Due Date”).

Failure to pay may result in your booking being treated as cancelled by you, with Section 5 applying.

2.5 Prices and currencies

  • All prices are shown in GBP (£) unless stated otherwise

  • Prices may change before booking confirmation but not afterwards except as permitted by law

2.6 Use of funds & financial protection

  • Booking funds are used only for your tour and related operational costs

  • Supplier payments are normally released only once arrangements are confirmed

  • Once a trust scheme is in place, bookings will be protected accordingly

 

3. What’s Included and What’s Not

Your Booking Confirmation specifies what is included.

Unless stated otherwise, the following are not included:

  • International flights

  • Passports, visas, and travel authorisations

  • Travel insurance

  • Vaccinations and medical expenses

  • Meals not specified

  • Optional activities

  • Personal expenses

  • Airport transfers unless expressly included

Optional add-ons are charged separately.

 

4. Changes to Your Booking (Amendments)

Changes must be requested in writing.

Changes are not guaranteed and may:

  • Incur reasonable administration fees

  • Require payment of any supplier cost differences

If a change is not possible and you choose not to travel, this will be treated as a cancellation by you.

 

5. Cancellations or Changes by Us

5.1 Minor changes

Minor changes (e.g. activity order, similar accommodation, transport adjustments) do not entitle you to a refund.

5.2 Significant changes or cancellation

If we make a significant change or cancel for reasons within our control, you may choose to:

  • Accept the change

  • Transfer to another tour

  • Receive a full refund

5.3 Minimum numbers

If minimum numbers are not met, we will notify you no later than 60 days before departure, offering:

  • An alternative tour/date, or

  • A full refund

5.4 Force majeure

If cancellation or change occurs due to force majeure, refunds or credits depend on supplier refunds.

5.5 Additional costs

We are not responsible for indirect costs (e.g. flights, visas) except where required by law.

 

6. Minimum Numbers

  • Minimum group size: 4 guests unless otherwise stated

  • If not met, cancellation may occur with refund or alternative offered

  • Additional costs incurred by you are not our liability unless required by law

 

7. Travel Insurance

Travel insurance is mandatory and must cover:

  • Medical expenses and evacuation

  • Personal accident

  • Cancellation and curtailment

  • Loss or theft

  • Any higher-risk activities

Failure to provide proof may result in refusal to participate or cancellation by you.

 

8. Health, Fitness, Accessibility & Special Requirements

You must ensure you are fit to participate and disclose any relevant medical or accessibility needs.

We may decline participation if health or fitness poses a safety risk.

Medical costs not covered by insurance are your responsibility.

 

9. Liability & Assumption of Risk

We are responsible for proper performance under the Package Travel Regulations.

We are not liable where failure is due to:

  • You or your party

  • Unconnected third parties

  • Force majeure

  • Unforeseeable events

Nothing limits liability for death, injury due to negligence, fraud, or non-excludable liabilities.

 

10. Conduct & Cultural Respect

You must:

  • Follow local laws

  • Follow guide instructions

  • Behave respectfully

We may remove guests without refund for dangerous, illegal, or disruptive behaviour.

 

11. Model Release & Media Consent

Tours may be photographed or filmed.

By participating, you grant Atlas & Nation a worldwide, royalty-free licence to use media unless you opt out in advance.

You may withdraw consent for future use.

All creative content remains Atlas & Nation intellectual property.

 

12. Online Store & Website Terms

  • No illegal or harmful use

  • Accurate information required

  • Digital products are generally non-refundable once accessed

 

13. Privacy & Data Protection

Your data is handled in accordance with:

  • UK GDPR

  • Data Protection Act 2018

  • Our Privacy Policy

Health data is handled confidentially and only shared where necessary for safety.

 

14. Force Majeure

We are not liable for delays or cancellations caused by events beyond our control, including natural disasters, pandemics, political unrest, government actions, strikes, or similar events.

 

15. Third-Party Links & Content

We are not responsible for third-party websites or services linked from our site.

 

16. Itinerary Changes & Flexibility

All itineraries are indicative and may change for safety, operational, or local reasons.

Changes that do not materially alter the experience do not entitle you to compensation.

 

17. Dispute Resolution

Complaints should be raised in writing as soon as possible.

Both parties agree to consider mediation before legal proceedings.

 

18. Governing Law

These Terms are governed by the laws of England and Wales, with exclusive jurisdiction of its courts.

 

19. Changes to These Terms

We may update these Terms from time to time. The version in force at booking confirmation applies.

 

20. Intellectual Property

All materials remain the intellectual property of Atlas & Nation and may not be used commercially without written consent.

 

21. Minimum Age Requirement

The minimum age to book and participate is 18 years, unless otherwise stated for a specific tour.
